Faculty of Law, University of Lucknow is organising Conference on Arbitration and Mediation at Crossroads- From Present to Future on April 28.
The Faculty of Law, University of Lucknow is a premier institution in India. The faculty is in pursuit of academic excellence purposes to organize a National conference on “Arbitration and Mediation at Crossroads: From Present to Future” on 28th April 2024 in Faculty of Law, University of Lucknow.
In the times when the pendency in the Indian courts have crossed the humungous five million mark, several modes of ADR have emerged as the exact panacea that the ailing judicial system desired at this critical juncture of the Indian legal history. Their efficiency and indispensability in the Indian dispute resolution mechanism is well recognized and for the same reason legislature and judiciary have promoted these methods in a sustained manner towards a positive direction.
The Arbitration and Conciliation Act, 1996 was passed in the year 1996 to facilitate and legitimize the arbitral awards. Limited grounds of appeals were made available to secure the commercial interests of the parties but this law still seems to oscillate between two schools of thought. While one advocates least judicial interference and complete party autonomy, the other, argues for necessary intervention in the event of miscarriage of justice. Similarly, arbitrability of issues remains a contestation despite periodic expositions by the courts.
The venue of the conference shall be New Campus, Faculty of Law University of Lucknow which shall be easily accessible from airport and Charbagh Railway Station Lucknow.
